Chief Justice Dr. Ahmed Abdulla Didi has stated that it was unconstitutional and unlawful if the Judicial Service Commission (JSC) is reviewing any ruling of the Supreme Court and called for these actions to be halted.
The statement by the Chief Justice today comes at a time when the JSC is investigating a disciplinary case of some Supreme Court Justices. JSC is investigating justices named in the report regarding unconstitutional rulings by the Supreme Court formed by the Commission to expose and probe into ultra-vires decisions and actions of the Sup0reme Court.
“Sun” has learned that JSC is investigating a disciplinary case involving Chief Justice Dr. Ahmed Abdulla Didi, Judge Abdulla Areef, Judge Adam Mohamed Abdulla, and Judge Abdul Ghanee Mohamed.
The Chief Justice’s statement read that it was unconstitutional for any government authority to attempt to create uncertainty about the Supreme Court’s constitutional and legal powers and to attempt to axe the powers of the Supreme Court in addition to challenging, disrespecting and disobeying its decisions as well as taking action against the judges that made the ruling which would also be in contempt of the court, since the Constitution clearly stated that any decision by the Supreme Court is final.
The statement also read that second-guessing or questioning the legality of any judicial decision or running any procedures regarding the matter whether it was an order or a ruling was a null or void process that no government authority has the power to do so.
Any action by JSC or its members in this manner was also against the law and oath taken by the members of the JSC, according to the statement by the Chief Justice.
