The Speaker of the Parliament and former President Mr. Mohamed Nasheed has said that with the decision taken by the Judicial Service Commission (JSC) to advice the three justices of the Supreme Court including the chief justice has renewed a lost feature or characteristic of the Constitution.
JSC has decided to advise the Supreme Court judges after it was revealed that the actions of the Supreme Court regarding a case being heard in the High Court which was in the enforcement process, impeded the right of appeal of a party in that case.
“Sun” has received information that the case in question is the case regarding the former deputy managing director of PSM Mr. Mohamed Ikraam Abdul Latheef’s debt documents.
The Speaker of the Parliament stated in Tuesday’s Parliamentary session that the Parliament was worried that the true intentions and elements of the Constitution were being eroded and that it wishes all of the core elements of the Constitution to be renewed. Mr. Nasheed also stated that the judicial process allowed every citizen three opportunities to prove their innocence and that they were the lower courts, High Court and Supreme Court.
Mr. Nasheed stated that it was not possible for the Supreme Court to take over a case being heard in the High Court. “A judge cannot enter into a case of another judge while it is being finalized.” Said Mr. Nasheed. The fact that JSC has decided to advise the Supreme Court judges regarding this matter was proof of JSC bringing back the rights provided in the Constitution, according to Mr. Nasheed.
JSC believed that the actions of the Supreme Court impeded the right of appeal of the parties in the case and strays from the principles provided in the justice process when it took the decision to advise the judges. The decision to advice the Supreme Court Judges over the matter has seen the judges be given a 30-day time period to address the findings of the investigative report
